Warranty

We here at KillerGear LLC (“KillerGear”) strive to manufacture only the highest quality products for our consumers. On the off chance that one of our products has a defect in materials or workmanship, we offer a 180-day limited warranty to help protect your investment and ours. Our limited warranty covering our products is as follows:

KillerGear warrants all of its products against defects in materials or workmanship for a period of 1 year from the date of purchase. All warranty claims are exclusive to the original purchaser of the product and are void if the product has been transferred to another individual. Any products purchased secondhand have no warranty and are sold as is. Similarly, products must be purchased directly from KillerGear or from a KillerGear authorized dealer in order to be eligible for warranty claims. KillerGear’s products are not warranted against neglect, misuse, abuse, or accident and any such occurrence voids the warranty. This includes, but is not limited to, leaving products out in the elements for extended periods of time. Likewise, only clear manufacturer’s defects in materials or workmanship are covered under the warranty and any damage suffered under normal use over time is not covered under the warranty. This includes, but is not limited to, scratches, dents, tears, bent parts, and separated decoy heads. Additionally, only products purchased by consumers for personal use are covered and any commercial use by the purchaser will void the warranty. Shipping damage is also not covered by the warranty and any such shipping damage must be reported immediately to the shipper of the products.

Any missing parts must be reported to KillerGear’s Customer Service Team within 30 days of receiving the product. Failure to report any such missing parts within this period will require the purchaser to purchase any missing items at set prices plus freight.

Claims must be initiated by contacting a member of KillerGear’s Customer Service Team via e-mail at moc.raeGrelliK@tcatnoc. If you would like to speak to us personally, a member of the Customer Service Team may be reached by phone Monday through Friday from 8am-5pm CST at 855-543-2701.  If our Customer Service Team is unable to answer your call, please leave a message with your name, phone number, and a good time to contact you.

All claims must be accompanied by proof of purchase clearly showing where, when, and by whom the product was purchased. Photos may also be required to initiate any claim. Proof of purchase and photos can be sent via e-mail, fax, or mail to an address provided by a member of KillerGear’s Customer Service Team after your claim has been initiated.

Claims may require shipment of the defective product to KillerGear’s manufacturing headquarters at the expense of the consumer. However, all such returns require a Return Authorization Number that will be provided to you by a member of KillerGear’s Customer Service Team after your claim has been initiated. Do not attempt to ship products to us without this number. Doing so could result in the loss of the product without replacement.

All replacement products or parts covered by this limited warranty will be shipped to the consumer at the expense of KillerGear.

KillerGear reserves the right to deny any defective warranty claim made towards any of our products.

OTHER THAN AS EXPRESSLY SET OUT ABOVE, KILLERGEAR IS NOT MAKING ANY SPECIFIC PROMISES OR WARRANTIES REGARDING ITS PRODUCTS. FOR EXAMPLE, WE DO NOT MAKE ANY COMMITMENTS ABOUT THE SPECIFIC FUNCTIONS OF THE PRODUCTS OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS.

ADDITIONALLY, OTHER THAN AS EXPRESSLY SET OUT ABOVE, KILLERGEAR’S PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KILLERGEAR HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN ADDITION, KILLERGEAR MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE REGARDING THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, OR AVAILABILITY OF ITS PRODUCTS. YOU AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE PRODUCTS REMAINS SOLELY WITH YOU.

If you have a dispute with KillerGear arising out of or related to your ownership or use of any of its products or this warranty, you agree to contact KillerGear first in writing and attempt to work it out amicably. If we are unable to work out a solution amicably, both you and KillerGear agree to final and binding arbitration in Iowa via the American Arbitration Association as the sole and mandatory procedure for resolving any disputes, claims, and/or causes of actions arising out of or relating to your ownership or use of any of KillerGear’s products or this warranty. The arbitration may be conducted electronically, shall be streamlined in procedure, and each side shall be responsible for their own costs related to the arbitration. To the fullest extent permissible by law, all disputes, claims, and/or causes of action must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purposed class, collective action, mass action, or non-paga representative proceeding.  The arbitrator may not consolidate more than one person’s claims or engage in any class arbitration.  Both KillerGear and I agree that we are both waiving the right to a trial by jury or to participate in a class or action.
